Terms of Service

 

Scope of Work  

Nayborlee will perform home care services (HandyPro, Homekeeping, Home Management, Routine Maintenance, Cleaning, Chef, Turnover, Senior Home Modifications) at the Homeowner’s address in accordance with the detailed invoice.   

Quotes/Estimates 

All quotes/estimates are valid for 30 days. All work excluding cleaning services are warrantied for 6 months from the service date. When requested by the customer, Nayborlee will provide a quote for each project, which expires after one month. Quotes will be emailed, and homeowner agrees to receive email from Nayborlee.

Quotes will include only those details we can visually inspect without removal of walls, coverings or other materials that may obstruct our view. Once work begins, if a new issue is exposed by uncovering the work area, the estimated price may increase.

Work may be scheduled after your quote expires, however, pricing adjustments may be required due to material or service cost changes. We charge a minimum fee of $130. We do not charge for drive time, but we do charge for wait time past 15 minutes. If you request rush, emergency or after-hours service and need us to start a project after normal business hours (after 5 or on Saturday or Sunday) our after-hours rate is increased.

Change Orders  

Nayborlee will perform only those services approved by the Homeowner. If the Homeowner shall, at any time, require services not listed in the scope of work attached to the invoice for services, a written invoice with the noted change order shall be created upon request and agreed by both parties prior to the performance of such work. 

Permits & Approvals   

Homeowner is responsible for procuring any permits or approvals required for the completion of the projects listed in the scope of work. This includes any zoning changes or changes to applicable covenants or local building guidelines.

Insurance & Loss Coverage 

Homeowner agrees to maintain adequate property insurance to protect against loss or damage due to theft, fire, vandalism, etc.  

Nayborlee agrees to maintain reasonable liability insurance to protect against personal injury or loss.  

Both parties agree to provide copies of the insurance certificates for their respective policies to one another.  

Property Access  

Homeowner agrees to be present at the scheduled work time to ensure that Nayborlee has reasonable access to the working area, including parking space. 

Nayborlee agrees to make a reasonable effort not to disturb or damage the Homeowner’s property outside of any demolition required for the project listed in the invoiced scope of work. 

Site Conditions  

The scope of work and pricing for the job are based on conversations and any walkthroughs completed by Nayborlee and Homeowner. Nayborlee has taken reasonable measures to ensure that the scope of work and pricing represent the entire project requirements, but cannot guarantee a final price due to the possibility of unforeseen complications. 

In the event that unforeseen complications, including (but not limited to) current state of the property/home, customer misrepresentations, mold, termites, rot, structural damage, or building code violations are discovered after the project begins, Nayborlee will cease work on the project and draft a change order listing any additionally required materials or labor. Homeowner agrees that any unforeseen complications may increase the final price of the project. 

Payment Schedule 

 

Homeowner agrees to make payments in accordance with the following payment schedule:  

50% deposit paid to schedule HandyPro, Senior Home Modifications and Personal Chef services.

Periodic Cleaning Pre-Payment minimum must be paid 100% at time of booking confirmation.

Remaining balance will be charged upon completion of work. Homeowner agrees to make payments via credit card directly to Nayborlee. Nayborlee will place a lien on the Homeowner’s property until receipt of final payment from the Homeowner.

 

Homeowner agrees to pay a $45.00 fee for Returned Charges. A 1.5% late fee will be assessed (calculated from the date of services) each month the balance is not paid in full. 

 

Final Inspection  

Homeowner will have the opportunity to review all completed work with Nayborlee.  

Warranty  

Nayborlee does not offer or imply any warranty for roof patch repairs, cleaning services or materials used for any project. Any defect or failure of parts or materials used in the project shall be the sole responsibility of the Homeowner.

Nayborlee shall extend a warranty for HandyPro labor for a period of six months. This warranty covers installation and workmanship. Should the Homeowner discover any incomplete, incorrect, faulty, or failed workmanship during the warranty period, Nayborlee shall correct such issues at their sole cost and expense.
  

Dispute Resolution 

Homeowner and Nayborlee agree to make reasonable efforts to resolve any disagreements related to this contract between themselves. In the event that the two parties cannot agree on an issue, both parties agree to resolve the issue through a civil court located in Gwinnett County, Georgia. The decision of that court shall be considered final. 

Governing Law   

This Nayborlee services contract shall be governed by the laws of Georgia.   

Acceptance 

Homeowner agrees that, having paid a deposit, and having read and understood the entirety of this Nayborlee contract that this contract shall commence as of the paid deposit invoice date with the full intent that all parties involved uphold and enforce the full terms of this contract at all times.
